数字图书馆建设中的著作权保护研究

摘要
以计算机、网络通讯技术为代表的因特网的崛起,使数字图书馆成为 21 世纪
图书馆建设的主旋律。在数字建设的热潮中,数字图书馆的著作权问题成为当前
国际学术界和政府管理部门关注的焦点。作为建设中的超大规模资源库,数字图
书馆面临海量文献资源数字化的著作权问题、数据库建设中的著作权问题和信息
咨询服务中的著作权问题。尽管世界各国针对上述问题都采取了相应的对策,但
是许多问题需要在深入探讨的基础上达成共识。
本文意在廓清数字图书馆的概念、特征、法律地位以及所面临的著作权问题,
探讨如何从法律上、技术上、管理上采取相应的措施以解决这些著作权问题,实
现真正的资源共享。第一章为引言。第二章是数字图书馆的概述。笔者认为,尽
管数字图书馆在信息采集、信息开发和信息服务的过程中其方式有别于传统图书
馆,但数字图书馆作为传播知识的大众媒体,其公益性的主体地位仍然不会改变。
第三章是数字图书馆建设中面临的著作权问题。笔者认为,数字图书馆面临的著
作权问题主要包括文献资源数字化建设、数据库建设和信息服务中面临的著作权
问题。第四章是数字图书馆著作权保护的对策,包括法律上的、技术上和管理上
的。由于篇幅和专业所限,笔者着重探讨了著作权法上的合理使用制度、法定许
可制度和著作权集体管理制度对解决数字图书馆面临的著作权问题的可行性、必
要性。以期在实现数字图书馆顺利发展的同时,又能维护好著作权人的合法权益。

Abstract
The emergence of , as the representative of puter and the
technology munication, makes the digital library e the theme of
the construction of the library in the 21st century. During the digital construction of the
library, the copyright issues of the library e one of the focuses that at present the
international theory circle and the administrative departments pay close attention to. As
the super large-scale resources bank under construction, the digital library faces the
copyright problem of magnanimity literature resource to be digitized, the copyright
problem of the database establishment and the copyright problem of information service.
Though countries all over the world has adopted countermeasures to solve that problems
described above, a lot of questions to be solves need to mon understanding on
the basis of discussing deeply.
The purpose of the dissertation is to clarify the concept, the characteristics, the
legal status of the digital library and the copyright problems the digital library faces, it is
discussed the corresponding measures to solve these copyright problems in order to
