文档介绍：Classified Index: CODE: 10075 .: NO: 20100329 A Dissertation for the Degree of Research on Non-prosecution Restriction System Candidate: Wei Yeifei Supervisor: Prof. Feng Jun Prof. Zhou Qingping Academic De gree Applied for: Juris Master Specialty: Juris Master (Law ) University: Hebei University Date of Oral Examination: March, 2012 摘要 I 摘要根据刑事诉讼的规律和发展趋势,我国 1996 年修改的刑事诉讼法进一步确立和完善了刑事不起诉制度,并在一定程度上与国际通行做法逐渐接轨。其中,不起诉制度自身具有的制约机制,就是重要标志之一。由于不起诉制度的核心是公诉权派生的不起诉权力,它的行使不仅可以导致刑事诉讼活动的终止,而且对案件的实体处理具有直接意义。因此,不起诉制度中的监督制约必须围绕着不起诉权力的行使来进行,使之既遵循“依法治国”普遍原则的基本要求,也符合“以法定起诉原则为主,以便宜起诉原则为辅”的法理基础。我国目前立法规定了被害人、被不起诉人、侦查机关、人民法院及人民检察院内部对不起诉决定的救济途径。笔者在对这几种不起诉监督制约途径的实际运作进行调查的基础上,具体分析在司法实践中存在的种种问题,并在此基础之上,提出进一步完善我国不起诉制约机制的若干构想。关键词不起诉制约机制检察机关刑事诉讼 Abstract II Abstract According to the development and rules of criminal procedure ,China has established and further perfected the criminal on-prosecu tion system by amending criminal procedural law in 1996 ,and has gradually matched up w ith the international practice . One of the important symbols is the innate restriction to non-prosecution ,which is to redress the wrongful non-prosecution decision made by the pros ecution through statutor y restrictions in order to ensure the defendants is rights and the realization of justice .Since the core of the non-prosecution system is a power not to pros ecute derived from the public prosecution whose implementation not only can cause th e termination of criminal prosecution , but also will affect the results of the cases , the supervision to the non- prosecution system shall focus on the enforcement of the power not to prosecute ,so that the enforcement of this power follow the principle of “ governing the state with law ”and the basic theory of “ statutory prosecution procedure assisted by simplified prosecution procedure ”.The present law of China prescribed the ways to redress the n
