在我国法制化进程中,律师行业具有重要的作用,如何提高律师的诚信状况自然成为我们国家法制化过程中的一个十分重要的课题。在现实生活中,律师行业的诚信缺失问题制约着我国的法制化进程,也影响到每个公民的合法权益的维护和保障。因此,构建严格的律师诚信制度来保障律师的诚信,已成为整个社会对于律师行业诚信建设的必然要求。我国是一个诚信资源非常丰富的国家,深入发掘传统文化特别是儒家传统诚信思想,对当前构建律师诚信制度具有重要的借鉴意义。建立一个良好的律师诚信制度,发挥诚信在律师执业过程中的制约和保障机制,使诚信由外在的保障机制内化为律师的道德修养和自觉行动,使制度和主体的自觉行为产生良性互动,才能真正发挥诚信的作用。律师作为一个特殊行业,其是否诚信不仅关系到当事人的利益,而且直接关系到国家的法制秩序和法制生活,为此,必须使律师执业过程透明化,保证其整个过程的公平公正,增加其公信力。所以,必须构建起现代的律师诚信制度,借鉴传统诚信文化资源中的优秀成果,结合现代律师执业规范,从而建立起适合中国国情的、独具特色的律师诚信体系。
