摘要
司法解释是我国法律体系的重要组成部分。当前,它在调整社会关系、指导我国各级人民法院审判工作,加强社会主义法制建设等方面有着非常重要的作用。随着我国社会经济的发展,各种新的社会关系不断涌现,原有的法律不可能预见及调整所出现的新的社会问题,而能够解决这些社会问题的有效途径之一即司法解释的运用。因此,研究我国司法解释问题,特别是正确认识和理解我国司法解释的合理性问题更具有重大意义。
本文共分三大部分。第一部分通过我国几位著名法学家对司法解释的定义以及我国司法解释的发展历程来探讨我国司法解释的特定内涵;第二部分通过对我国立法解释的局限性及法律自身存在的缺陷来阐述我国司法解释的成因;第三部分即本文的重点,通过司法解释存在的理论依据及其巨大的现实意义来探讨我国司法解释的合理性.

Abstract
Judicial interpretation of China's legal system is an important part. At present, the adjustment in social relations, guiding the people's courts at all levels of China's judicial work, strengthening the socialist legal system building and has a very important role. As China's social and economic development, all kinds of new social relations will continue to emerge, the original law can not be foreseen and adjusted by the emergence of new social problems, and these social problems can be solved one of the effective ways is the use of judicial interpretation . Therefore, the study of China's judicial interpretation, in particular a correct understanding of China's judicial interpretation and understanding of the reasonableness of the problem is of great significance.
This paper is divided into three parts.
