文档介绍：摘要宽严相济刑事司法政策是基于构建和谐社会的背景下,当前打击罪犯、改造罪犯的有效策略,体现了以人为本、公平正义的刑事法治理念,是监狱顺应社会文明进步的重要标志。近年来,刑法修正案(八) 出台以及今年中央政法委出台指导意见从严规范减刑、假释、保外就医,对刑罚适用对象以及执行力度的修改都体现出更为严格的趋势, 但是伴随着刑罚功能不断完善,监狱的押犯结构改变、执法成本高以及监管压力大等现实因素都使在监狱贯彻宽严相济的刑事政策十分必要和迫切。本文通过分析当前实施这一政策中存在的日常监管中从“严”而忽视“宽"的问题、减刑中条件过宽、适用率过高以及人为设置比例的问题以及假释中附加条件多、“责任倒查”影响假释的适用存在的问题,提出要完善以分级管理为基础的狱政管理制度和建立以假释施之以宽、减刑施之以严的刑罚制度来全面落实宽严相济刑事政策,以此达到更好地矫治罪犯、降低重新犯罪率的目的。关键词:宽严相济刑罚执行运用万方数据 Abstract Criminaljudicial policy isbased bining thebackground of building aharmonious society,under the current effectivestrategyagainst criminals,rehabilitation,embody thepeople—oriented,the concept of fairnessandjustice ofcriminallaw,and is allimportant symbol ofprison conforms criminal law amendment (eight),and thisyear mittee issuedguidelines strictly mutation such release on parole ofpenalty,the penalty applicableobjects and theenforcement of themodification is astricter trend,but with penalty function constantly improve,the prison of mobsters structure change andhigh costoflawenforcement andpractical factors such asregulatory pressure tomake inthejail tocal'ry out the criminalpolicy oftempering justice、)l,im mercy isvery necessary and urgent.
