摘要
2007 年《物权法》出台,其中明确将探矿权和采矿权作为一项民事财产权利
收入物权的范畴,在一定程度上推动了矿业权流转秩序的活跃和有序。但是随后
2009 年山西省率先掀起的矿产资源整合运动,又一次将社会各界的视线拉回到国
家矿产业中来,不过这一次,却是大大压缩了矿业权市场的范围。现在,这两条
相背离的发展道路被一同展现到社会面前,都希望能够完善矿业权市场,提高矿
产业效率,减少资源浪费以及维护矿业安全和可持续发展。那么,矿业权究竟应
该何去何从?面对这个问题,本文将首先以经济学原理和我国矿产业领域近代发
展的现实为基础,提出矿业权市场需要通过完善流转方式来进一步深化市场化改
革的思路,然后以矿业权背后的价值基础为依托,以国外矿业权发展的经验为借
鉴,希望进一步对我国现行矿业权流转法律制度进行分析和论证。结合目前国内
学界的学术研究成果,可以发现,矿业权法律制度的理论方面,已经形成了丰富
的研究成果,为矿业权流转法律制度的研究奠定了坚实的法理基础,同时,目前
也已经有部分学者开始对矿业权流转法律制度进行研究,并且极具启发性。所以,
本文希望在借鉴前人研究的基础之上,选择矿业权流转方式这一切入点,通过对
矿业权流转方式的法律规范的分析,结合矿业权流转的现实案例,以矿业权的出
让、转让、出租、抵押、承包、继承这六种流转方式为对象,来对矿业权流转方
式法律制度进行补充和完善。

Abstract
The Property Law had been promulgated in 2007, it clearly included mineral
exploration right and mining right as civil property rights in property rights of category.
In a certain extent, it made the circulation order of mining rights active and orderly.
However in 2009, shanxi province first implemented the integration movement of
mineral resources, and attracted the attention from all of the society again. But at this
time, it was pressed the mining rights market. And now, for perfecting the
mining rights market, improving the mining industry efficiency, reducing the waste of
resources and maintenance of the mineral safety and sustainable development, the two
ways which are so different are being shown to society. Then, which way will the
mining rights exactly go? Confronted with this problem, at first, this paper will base on
the economical principle and the reality of the development in our country mining
industry, and advance the viewpoint that the mining rights market will need to improve
the transfer of mineral rights for the further marketizational reform, and then, it will
base on the value foundation of the mining rights and make the foreign development
experien
