文档介绍：大连海事大学硕士学位论文船舶挂靠法律问题研究姓名:沙晓岑申请学位级别:硕士专业:国际法学指导教师:韩立新 20090601 中文摘要摘要本文研究的主要问题是船舶挂靠涉及的法律问题。本文共包括五章内容。第l章从涵义、组织形式、历史沿革、利弊入手,对船舶挂靠进行了较为全面的介绍,并指出,尽管实践中船舶挂靠引发了不少问题,但是作为仍然具备生存土壤的一种水路运输经营模式,有必要对其进行深入研究,并对其加以改善。第2章为了进一步加深对船舶挂靠经营性质的认识,通过与几个与船舶挂靠有相似之处的法律制度,即隐名合伙、雇佣关系、代理关系、联营关系和名义借贷的比较来剖析船舶挂靠的法律性质,并得出相应结论。第3章结合几个具体案例对船舶挂靠经营中出现的民事法律责任进行了探讨, 进一步明确了船舶挂靠经营当事人的法律地位及权利义务。本章就船舶挂靠经营涉及的合同责任和侵权责任分别进行了研究,并具体分析了几种常见责任,包括运输合同责任、保险合同责任、人身伤亡和财产损害责任、海洋环境污染责任和挂靠内部侵权责任的解决方式。第4章明确了船舶挂靠当事人在诉讼中的地位。本章具体分析了合同之诉、侵权之诉以及内部纠纷中被挂靠人与挂靠人谁是适格当事人:在挂靠船舶被扣押的情况下被挂靠人与挂靠人谁应该提供担保。第5章从立法建议和行政管制两个方面对船舶挂靠经营的规制提出相关建议。根据前四部分的探讨,本章论述了从行政法角度明确船舶挂靠的法律地位、从民法角度明确船舶挂靠的法律性质、从诉讼法角度明确被挂靠人与挂靠人在诉讼中的地位的必要性,并强调了整顿现有的船舶挂靠经营业务以及将监管对象的范围扩大到挂靠人的重要性。关键词:船舶挂靠;法律性质;民事责任:诉讼地位 Abstract The focus point ofthisarticle is to analyze the legal issues arising from the addition totheintroduction and conclusion,the articleisdivided intofivechapters.
