文档介绍：华中科技大学硕士学位论文 I 摘要新修订的刑法设专条规定了医疗事故罪,这是实践中处理医疗事故刑事案件的基本法律依据。由于医疗活动的专业特性,我国刑法把医疗事故罪从普通过失犯罪中独立出来,单独规定是合理的。但是刑法第 335 条对于医疗事故罪的罪状的描述太过含糊,对于该罪的法定刑规定了较为单调的刑种。这种规定导致了司法人员在实践中难以适从,必将导致司法的不统一和混乱。理论上学者们关于医疗事故罪的观点之分歧在于对犯罪主体、主观方面和客观方面的认定,不少学者对于本罪的法定刑设置也提出了自己的主张。本文对医疗事故罪的概念、构成特点、认定与处罚以及立法完善逐一进行进行了分析和探究,提出了粗浅的看法,以期对司法实践中的适用起到参考作用。关键词:医疗事故罪犯罪构成认定立法完善华中科技大学硕士学位论文 II Abstract Crime of medical negligence has been provided as a special provision in the newly Crime Law ,which is regarded as the primary basis in dealing with criminal cases of medical negligence a separate provision fr mon unpremeditated crime due to the special nature of medical activity. However, the description of guilty facts about Crime of medical negligence in article 33 5 of Criminal Law is too ambiguous , and the classification of legal punishment of this cr ime provided is relatively scarce. And the scarcity results in judicial professional’s hesitating about which article to apply , which will definitely cause judicial inconsistency a nd confusion. Neverthele ss, scholars disagree theoretically with each other on th e establishing of the main body , the subjective and objective aspects of a crime of medical negligence ,many scholars do put forward their own proposition on the setting of legal punishment of crime of medical negligence. The author of this paper is trying to make an analysis and an exploration of the notion ,the composing features ,the establishment and punishment and the perfection of legislation of Crime of medical negligence respectively , and gives his own sh allow opinion as well , hoping to help in judicial practice.
