摘 要：生命权归个人所有，即个人对自己的生命拥有全部权利，包括任意处置自己的 生命，其他任何人或组织无权T涉。儿十年來，由于來自民间对安乐死的呼声日趋强烈， 补会一玄没有放弃对安乐死立法的努力。在赞同与反对两种声音激烈交锋的同时，民间补• 会对绝症患者实行安乐死C经屡见不鲜。本人认为止个体平静而有尊严的死去是人的基本 权利，个人应当有选择生的方式和死的自由的权利。安乐死制度从表血上看符合故意杀人 罪的构成要件，但实质上，安乐死不具有构成犯罪所要求的相当社会危害性，其根木H的 却是为了减少病人临死前不堪忍受的痛苦或家属的沉重负担；安乐死制度的合法化是一种 观念的史新，也是对生命和死亡的再认识。
实施安乐死涉及人的生命权，必须谨慎行事，立法机关应予以立法，立法内容应包括明 确安乐死的适用对象，安乐死的适用条件，安乐死的实施方法，安乐死的实施程序，安乐
死的警戒机制、以及违反安乐死法的刑事贵任，川严格的制度保障安乐死人行具道。安乐 死制度合法化将成为丿力史发展的必然，是刑法现代文明的要求。

Abstract： The right of life belongs to a person, namely a person has the completely right to own life, including handles own life and other anybody or the organization has no right to interfere. For several dozens years, the calls of euthanasia comes from the folk intense strongly,so the society always not giving up the endeavor of the euthanasia approves of and opposed two kind of sound intense strongly, the folk implemented the eutha nasia to in curable illness patient already unconun on • In iny mind, dying with dignity is human，s basic right, individual must have the right to chose the freedom of life and the euthanasia system is suit for the murder crime constitution superficially, in the essence, the euthanasia not have the sui table social hazardous nature which the murder crime constitut ion request, i ts primary purpose is to reduce the painful or fam i1y member's serious euthanasia system legalization is a renewal idea and reunderstending of the life and death・
