文档介绍：诈骗罪探究摘要诈骗罪是古老而又常见的侵犯财产罪中的一个具体罪名,又是欺诈类犯罪的一个具体罪名,在我国刑法分则中占有重要地位。随着经济的发展、技术的进步,诈骗罪的犯罪形态、表现方式日益复杂,对诈骗罪进行进一步研究具有重要的理论和现实意义。全文以诈骗罪的概念与地位为起点,以诈骗罪的构成要件为贯穿全文的主线,以诈骗罪的认定为结束,针对理论和实务界关于诈骗罪构成要件及认定中的争议问题进行论述。首先简述了诈骗罪的概念、地位和立法沿革。接下来重点探讨诈骗罪四个构成要件中的争议问题,并提出自己的观点。最后从司法实践的角度对诈骗罪认定过程中的既遂、未遂区分、数额标准和相关罪名的区分进行了探讨。对诈骗罪这一具体罪名进行探究不仅对刑法个罪的完善具有积极作用,对整个刑法系统的科学化也起着重要作用。关键词:诈骗罪犯罪构成认定洲DY ON FRAUD ABSTRACT Fraud is an old mon crime and is one kind ofcrime of encroachment upon occupies allimportant position in thetheories ofcriminal addition,fraud ischanging dramatically with thedevelopment of theeconomy,culture,and thechange inpeople’S lifestyles e more thiscase,thestudy offraud is very important asitrelates tocriminal lawtheory and of themodernization oftheeconomy,the definition offraud isdisputed, especially what constitutes thecrime offraud andhow fraud isdifferent from othercrimes. This paper discusses thedispute oftheconstitutive requirements of fraud and thedifference between fraud and willexplore theposition offraud andlegislation inboth China andforeign countries. Secondly,it willgive theauthor’Sown view based on thefouraspects of theconstitutive requirements offraud,including theobject ofcrime,the objective aspect ofcrime,thesubject ofcrime,and thesubjective aspects ,this paper discusses how to determine thedifference betweenattempted fraud and actual fraud and how todetermine the severity ,it willexplore how fraud isdifferentfrom stealing,contractual fraud,and bribes SO thatthejudicial system can benefit.
