文档介绍:烟台大学硕士学位论文立法膨胀论姓名:赵磊申请学位级别:硕士专业:法学理论指导教师:王加卫 20100312 I 摘要法治,是政治文明发展到一定历史阶段的产物,为各国人民所向往和追求。自近代以来,中国人民为建设自己的法治国家,进行了长期的不懈奋斗。在建设法治国家的进程中,反思立法进程,总结立法经验对法治国家的建设是必不可少的。法律的健全、法律体系的完善是衡量法治国家建设的重要标准。所以,长久以来我们的立法理念就是快立法、多立法、学西方。这也使得我国的立法工作一直处于一种“欣欣向荣”的状态。但相较于立法的这种“欣欣向荣”,预想中的法治国家似乎并没有如约而至。倒是伴随着法律的膨胀出台,一系列社会失范现象——社会道德水准下降、法律规避、******等等——层出不穷。这一切的一切都促使我们反思,问题到底出在何处?促使我们反思法律的作用到底是什么?法治是不是只有一种建设模式?法治是不是就是立法建设?自然答案是否定的。文章指出目前指导我们的立法理念出现了偏差,那种认为只要制定出足够多的法律就能建成法治国家的想法是幼稚可笑的, 法治国家建设并不是立法的一维活动, 它是一系列活动的综合体系。同时法治也不是只有一种普世的、放之四海皆准的模式。法治国家建设需要我们从自身的社会文化、历史****惯出发。那种认为只要照抄、照搬西方先进法治国家已有法律制度的想法,不仅不利于我们的法治国家建设,相反其更有可能是在阻碍我们的建设进程。关键词: 立法膨胀;法治;城乡二元结构 I Abstract The rule of law signifies that a political civilization has deve loped to a certain historic stage. It is desired and pursued by people of all countries. The Chinese people have made protracted and unremitting struggl es for the building of a country under the rule of law since modern times. In building Ch ina into a country under the rule of law, it is indispensable for Chinese people to reflect on the legislative process and to summarize legislative experience. The perfec tion of law and the improvement of legal system are the important criteria for measur ing the building of a country under the rule of law. Based on this understanding, China has formed a legislative concept for a long time, that is, to legislate as soon as possible and as much as possible and learning from the west, which makes China’s legislative work has always been in a “flouring” state. Comparing with the “flourishing” of legisl ation, it seems that the expected country under the rule of law has e in time. However, with the expansion of the law promulgation, social anomie – the decline in mora l standards, the evasion of law, corruption, etc – is frequently occurred. All of these urge the Chinese people to reflect the questions: Where does the problem occur? What is the function of law? Is there exists only one model of legal construction?
