文档介绍：中文摘要中文摘要毒品是万恶之源,它不仅诱发了大量的刑事犯罪和治安事件,影响了社会秩序,而且引发了一系列严重的社会问题。随着我国改革开放步伐的加快,毒品犯罪问题在我国也越来越严重。非法持有毒品罪是我国刑法规定的毒品犯罪中的一个独立罪名,但由于毒品犯罪的特殊性及刑法理论学界对非法持有毒品罪研究的不多,司法实践中对非法持有毒品罪的认定很难把握,为此,笔者拟通过此文对非法持有毒品罪进行粗浅的探讨。本文分为以下四个部分:首先对持有型犯罪进行概述并进行立法必要性分析, 作为引导出非法持有毒品罪的铺垫。其次,本文对非法持有毒品罪作了深入的解析。分别从概念、犯罪构成、犯罪特征、归责原则以及立法沿革和立法评价等方面作了详细剖析,并对一些争议问题发表了自己的见解。再次,本文对非法持有毒品罪进行了司法认定。主要围绕非法持有毒品罪与非罪、此罪与彼罪、一罪与数罪、两种特殊人群非法持有毒品行为的定性、持有假毒品行为的认定、代买毒品行为的认定等六个方面作进行了比较深入和细致的分析。最后,针对非法持有毒品罪在立法和司法实践中存在的不足,提出对非法持有毒品罪立法完善建议。通过以上探讨和分析,笔者对于“持有’’行为的性质、非法持有毒品罪的罪数形态、归责原则、与其他毒品类犯罪的区别等等内容作出了较为明确的界定。以期能对毒品犯罪的理论研究和实践工作有所帮助。关键词:持有;归责原则;犯罪构成;司法认定;完善内容黑龙江大学硕士学位论文 Abstract Beingregarded弱the sources ofaUevilthings,drug-related activities Carl not only induce alarge number ofcriminal and securityincidents,which disrupt the socialorder, butalsolead to thespeeding up ofChina'sreform and opening up,drug—related crimes have e more and more rampant in OUr country.
