文档介绍：中文摘要中文摘要近年来,随着我国经济、文化的迅猛发展和人民群众法律意识的逐步增强, 民事起诉这一制度逐渐走入普通老百姓的生活当中,不再束之高阁。民事诉讼法的修改也使这一制度成为新闻媒体的关注的焦点,如何保障人们更容易接近司法, 如何走向和接近救济成为人民群众想要了解的关键问题。而首先需要了解的是公力救济。公力救济是现代社会理性、合法的救济途径。民事起诉权的行使,是人们接近司法、寻求司法保护的起点。合理、有效保障民事起诉权,对于人们正当民事权益的保护、诉讼的正常进行、司法能动性的发挥、制定法的完善,乃至推动我国的法治进程都具有极为重要的意义。文章主要从三个部分来论述民事起诉条件。在分析其深刻的社会背景与司法环境的基础上,结合域外的解决机制,针对我国的客观实际情况,提出了重构适合我国国情的民事起诉条件机制。关键词:起诉条件;诉讼要件;诉的利益;立案登记制度黑龙江大学硕士学位论文 Abstract ■l In recent years,with the rapid development of China’S economy,culture and people’S legal awareness es stronger,the civilsuit,thissystem intothelivesof ordinary people,no longer on oftheCivilProcedure Law also makes thissystem became thefocus ofattention ofthe news media,how toprotect it easierforpeople to aCCeSS tojustice,and howto鲥ke and close tothe reliefofthekey issues forthemasses ofthepeople want firstthing you need toknow is thatpublic relief intoday’Ssociety isrelatively reasonable,legitimate means ofrelief.
