文档介绍：摘要摘要家庭暴力是一个全球性的社会现象,在世界范围内,无论是发达国家还是发展中国家都不同程度的存在着。研究和探讨家庭暴力问题,已引起了国际社会和各国政府的重视。我国在反家庭暴力方面也进行了积极的努力,取得了很大的成效。但是从总体上看,目前我国反家庭暴力的法律界定和立法框架在实施机制上尚不适应实际需要,特别是操作性不强、缺乏惩戒措施,司法干预和介入还存在很大的困难;公众法律意识较淡薄;对政府部门职责规定不明,特别是缺乏公安机关对家庭暴力干预的操作细则,使得公安机关权责不清,造成干预中介入不够主动和及时,使得我国反家庭暴力工作进入了一个瓶颈期,不利于家庭暴力受害者合法权益的保护。遏制家庭暴力是一个复杂的社会工程,仅靠立法、执法等部门任何一家都不可能解决,预防和制止家庭暴力需要全社会的参与。因此有必要对家庭暴力问题进行系统的研究,文章在对家庭暴力进行界定的基础上,分析了我国反家庭暴力的现状,从多个视角对反家庭暴力的法律对策、援助机构、预防措施等方面进行了系统的研究,提出了完善我国反家庭暴力体系的对策。关键词:家庭暴力;现状;成因;防治对策 n Abstract Abstract Domestic violence is aglobal socialphenomenon intheworld,both developed and developing countries have varying degrees and explore theissue ofdomestic violence,has caused munity and thegovernments ’s violence has alsomade positive effortsand achieved great thewhole,China's anti—domestic violence laws andlegislation to define theframework of theimplementation mechanism is not yet meet theactual needs,in particular,interoperability is not strong,the lackofdisciplinary measures, iudicial interference and intervention are stillgreat difficulties;public Aweak sense of the law;on the provisions of unknown functions of government departments, particularly thelack ofpublic ans of thedomestic violence intervention in thedetailsoftheoperation,making ambiguous division ofresponsibilities between the public ans,resulting in lack of intervention of initiativeand involvement in atimely manner,making China’santi-domestic violence intothework 0ftheA bottleneck period is not conducive to thevictims ofdomestic violence to protect thelegitimate fights and domestic violence is acomplicated socialproject alone legislation,law enforcement departments can not beany solution toprevent and stop domestic violence needed toparticipate insociety as awhole· There is aneed tostudy thesystem ofdomestic violence,in thisarticle Oll the definition ofdomestic violence on the basis of an analysis ofChina’S anti-domestic violenee the
