文档介绍：摘要 I 论我国的违宪审查制度及其改革摘要宪政国家的建立,与完善的违宪审查制度,休戚相关。而违宪审查制度能够发挥效用,在很大程度上,取决于宪法权威性的树立以及行之有效的违宪审查机构。在我国,宪法条文中很大一部分反应政治性的口号,而我国建国以来,良性违宪的实践印证了上述观点。宪法作为公民权利保障书的功能并没有真正体现。本文借鉴了美国和德国的例子,论述了宪法权威性的树立并不是一蹴而就的。本文建议通过宪法司法化,即将宪法作为案件审判的规范依据的途径,树立宪法的权威。另一方面,本文通过介绍不同违宪审查模式的理论基础以及法律传统,论述了我国不能照搬专门机构与普通法院审查模式。我国目前违宪审查模式的缺陷在于工作效率不高、缺乏专业性,对于违宪审查建议缺乏必要的程序性规定等方面。因此,本文提出,我国应在全国人民代表大会及其常务委员会的隶属之下设立专门的违宪审查机构——违宪审查委员会,并出台专门规定违宪审查制度的立法,对特定国家机关以及其他主体的违宪审查申请权作出同等规定,并确保违宪审查决定能够具有拘束效力。关键词: 违宪审查宪法权威性宪法司法化违宪审查机构违宪审查委员会违宪审查程序立法中国政法大学硕士学位论文论我国的违宪审查制度及其改革 II ABSTRACT Constitutional Review is vital to the establishment of a constitutional state. Effective constitutional review,to a large extent, depends on authoritativeness of Constitution and efficient constitutional review bodies. Since the founding of our nation, constitution provisions, at some point, compose mostly of political slogan , which was confirmed by the benign unconstitutional practices. Constitution did not really play the role fo guardian of basic rights of citizens. This article draws on the example of the United States and Germany to discuss that establishment of Constitution authoritativeness cannot be achieved in one day. The article suggests that throughjudicature of constitution, which means to avail of Constitution as normative basis in the process of the trials,to establish authoritativeness of Constitution. On the other hand, the paper introduces the theoretical basis and legal traditions of different constitutional review modes. Chinacan not totally copy the constitutional review modes of other countries. The article proposes that China should establish specialized constitutional mittee under the leadership of the National People's Congress and its Standing Committee. And meanwhile, procedural rules should be put forward in accordance with establishment of mittee. KEY WORDS :constitutional review,authoritativeness of
