文档介绍：中文摘要未成年人因生理、心理特殊性,在刑事责任能力和犯罪行为方面,与成年人相比有着显著的不同,因此,未成年人承担的刑事责任亦体现出非成人化特征。刑事责任本身虽具有法律上的独立实体意义,即对犯罪的否定评价和非难, 但是,要实现刑事责任报应已然之罪与预防未然之罪的目标,还必须使抽象的、可能的刑事责任转化为具体的否定和谴责活动,即必须使刑事责任转化为具体的制裁措施和处理形式。因此,实现刑事责任承担方式非成人化是实现未成年人犯罪刑事责任非成人化的实质所在。这也就是研究未成年人犯罪刑事责任承担方式之意义所在。本文从辨析未成年人犯罪、刑事责任承担方式等基本概念入手,通过对国外未成年人犯罪刑事责任承担方式考察,得出各国专门适用于未成年人的刑事责任承担方式具有非成人化特点的结论。由于我国的现行刑法典对刑罚功能有限性及监禁刑的弊端认识不足,在控制和预防未成年人犯罪上过分依赖刑罚, 未成年人刑事责任承担方式未充分体现非成人化、轻缓化的发展趋势。就此, 笔者提出了完善我国未成年人刑事责任承担方式的建议:在立法模式上采用在刑法典中设立未成年人专章,构建一套多元化的、体现轻缓化内涵和非成人化特质,层次分明、由轻到重的适用于未成年犯的刑事责任承担方式——定罪免除处罚和处罚措施,处罚措施应以非刑罚处罚方法、非监禁刑为主要形式。关键词:刑事责任承担方式未成年人轻缓化 Abstract Due to the biological and psychological factors,teenagers are different from adults inthecapability totake thecriminal responsibilities and the means mit criminal responsibilities taken by theteenagers alsodiffer from those by responsibility has itsown substantial meaning inthelaw,which appraises crimes negatively and reproaches abstract and possible criminal responsibility must betransformed intosubstantial denying andreproaching activities inorder toachieve thegoal ofpreventing potential crimes bypunishing achieve the goal ofmaking teenagers take different criminal responsibilities from adults,the way forteenagers totake criminal responsibilities must bemade todiffer from isthe aim to research the way forteenagers to take criminal on analyzing the basic concepts on juvenile delinquency and theway forteenagers totake criminal responsibilities,and researching some nation’S practices inthisfield,such asAmerican’S,this thesis gets theconclusion thattheway forteenagers totake criminal responsibilities isdifferent from adults inallother nations;that thelimitation ofthe punishment function isnot given enough attention in Chinese criminal code;that thecontrol andprevention ofjuvenile delinquency relies too much on criminal punishment;that the way forteenagers to take criminal responsibilities has no difference
