摘要
目前我国农业水资源保护已经初步形成了以《中华人民共和国宪法》为核心,以《中华人民
共和国水法》、《中华人民共和国水污染防治法》等法律为基础的法律体系,我国农业水资源保护
的法制建设基本上做到了有法可依、有章可循。但毋庸置疑的是,我国农业水资源现状的形势十
分严峻,农业水资源保护立法己经充分暴露出诸多问题与缺陷,因此,我国农业水资源保护立法
是十分必要和迫切的。我国农业水资源保护立法主要存在以下几方面的问题:农业水资源保护法
缺失、立法进程的相对滞后、立法缺乏现实可行性和操作性、立法体系不完善、法律法规相互矛
盾、协调性差等。这些问题不仅直接影响了我国农业水资源保护立法的质量及法律的可实施性,
也影响了我国农业水资源开发和利用的可持续性,最终影响到我国农业、经济和社会的发展。针
对上述弊端与缺失,笔者归纳整理了国外农业水资源保护立法的经验,总结了我国农业水资源保
护立法应追求的价值取向,从农业水资源保护立法模式的选择、立法目的和立法原则的确立、立
法内容的完善、管理体制的健全等方面进行思考和探析,以调整和完善我国农业水资源保护的立
法现状。

Abstract
At present our country agricultural water resources protection has initially formed by the constitution as the core,
with "water", "water pollution prevention law legislation system on the basis of agricultural water resources protection,
the legal construction basically did, rule-based barriers. But undaunted, the present situation of China's agricultural water
resource in the situation is very serious, already fully exposed in agricultural water resources protection legislation
existing problems and defects. Explore the root of the problem, because of China's agricultural water resource protection
legislation mainly exist in the following several problems: the agricultural water resources protection loss, the legislative
process, the relative lag reality feasibility and operability lack of legislation, legislation system is not perfected; laws and
regulations such contradiction and coordination. These problems not only directly affecting China's agricultural water
resource protection legislation efficiency, quality and legal implemental, also influence of China's agricultural water
resource development and utilization of the sustainable, ultimately affect the agricultural, economic and social
development. In view of the above
