摘要
饲养动物致人损害责任，是社会中客观存在的一种侵权责任。随着社会的发展，人们管领动物的范围日趋多样并复杂化,由此造成的相关损害也接踵而至。动物致人损害责任的地位日益突出，成为侵权责任体系中不可缺少的部分。新制定的《侵权责任法》对饲养动物致人损害责任作出了比《民法通则》更为详细的规定，是我国立法上的一大进步，也使司法实践中的不少问题得到了解决。但《侵权责任法》关于饲养动物致人损害的规定只具有原则性，欠缺具体操作性，并且在责任承担主体、损害赔偿机制等方面还有待于进一步完善。本文针对我国饲养动物致人损害责任承担的问题，从以下三个方面进行讨论，以求对其有一个较为全面、整体的认识。
第一章是饲养动物致人损害责任承担的概述。通过阐述饲养动物致人损害责任承担的理论基础、饲养动物致人损害责任承担的构成要件以及饲养动物致人损害责任承担的基本原则等问题,阐明饲养动物致人损害责任承担的原因以及相关要件。
第二章是饲养动物致人损害责任的承担主体。本章从饲养动物致人损害责任承担主体的概述、侵权责任形态、国内外立法关于饲养动物致人损害责任承担主体的规定、,并在此基础上结合我国的司法实践以及国外立法的先进经验，对我国饲养动物致人损害责任的责任承担主体的完善提出建议。
第三章是饲养动物致人损害责任的赔偿。本章论述了饲养动物致人损害责任的承担方式，并对国内外的饲养动物致人损害责任的承担方式进行了比较法考察。着重对饲养动物致人损害责任的损害赔偿原则与形式进行阐述，针对现状的不足提出合理化改善建议,提出建立社会救济机制、国家补偿机制的建议,并探讨惩罚赔偿问题。
通过本文的研究,笔者对饲养动物致人损害责任的承担主体与损害赔偿机制提出了一己之见，力求对我国饲养动物致人损害责任的立法完善有所裨益。

Abstract
The responsibility of feeding animal causing men damaged，is an objective reality tort liability in society. With the development of the society， the animal area which people managed become much more diversificated and complexed，related damaging also follows. The position of the responsibility of feeding animal causing men damaged becomes more and more important, and turns into indispensable part of the tort liability system. Newly established ”Tort Liability Act" on the responsibility of feeding animal causing men damaged used more articles than the " General Principles of the Civil Law ”, it is not only a great progress in legislation of our count, but also resolves many problems in judicial practice。 But ”Tort Liability Act" on the responsibility of feeding animal causing men damaged only has the principle provisions, lacking of the concrete operation and needs to be further improved in liability body and the main responsibility for damage compensation mechanisms.  With this view of the responsibility of feeding animal causing men damaged to the problems of accountabil
