文档介绍：.页眉. .页脚网络犯罪立法研究摘要随着互联网在人们生活中的广泛应用, 我国的网络犯罪数量也呈现出逐年增加的趋势, 这已经成为社会关注的焦点问题之一。正是在这种背景下, 网络犯罪立法变得刻不容缓。从目前国内网络犯罪立法的状况而言,许多问题缺乏法律依据,得不到法律上的正式回应。集中表现在执法实践中对网络犯罪的定义不清晰, 造成取证难, 判刑难, 最终使得很多网络犯罪事件无法得到公正处理。针对这种状况, 我们必须加强对互联网的立法研究,尽快健全打击网络犯罪的法律体系, 切实提高依法预防和打击网络犯罪的能力, 处理好网络犯罪的相关问题。论文整体分为六个部分, 第一部分是充分阐释了选题的意义和选题背景。第二部分是对互联网和网络犯罪进行了定义。并对网络犯罪和计算机犯罪进行了比较, 两者的特点进行了阐释。第三部分是网络犯罪立法现状,通过具体的实例对网络犯罪发展情况进行具体的研究, 从网络犯罪的立法进行分析, 从历史到发展进行研究, 然后从实际犯罪立法情况及国外和国内的网络犯罪入手, 分别举出多个基本实例, 进行分析, 分析其产生的问题, 提出解决办法, 对网络类型犯罪进行研究,分别以网络为对象,以网络为工具以及网络财产问题,三个问题进行分析。第四部分是研究我国法律存在的不足, 主要从网络犯罪侵犯的客体不明确、网络犯罪缺乏单位犯罪的相关规定、网络犯罪的刑罚种类单一三个方面入手进行解析。第五部分是完善网络犯罪的立法提出对策。最后全文进行总结。本文主要针对目前网络犯罪问题较为严重现象, 从网络犯罪形成原因、表现形式、解决对策三个方面, 研究网络犯罪问题和网络法律问题, 并提出了解决此问题的方法与对策。关键词:. .页脚 C YBERE CRIME LEGISLATION RESEARCH abstract With the wide application of the in people's daily life, the number of China's crime has increased year by year, it has e one of the focus of social problems.
