文档介绍：。刊。砸目录 IY㈣黼2呲7㈣0嘲2岫㈣1 4m9矾. 中文摘要???????????????????????.???????????.i 万方数据中文摘要随着国际贸易的发展,以及知识产权国际保护的不断加强,知识产权壁垒和贸易自由化之间的矛盾日益突出。权利穷竭原则作为对知识产权的限制之一,平衡了知识产权权利人和社会公众的利益。但目前世界各国关于权利穷竭原则的理论著述与司法实践存在着很大分歧,国际社会就权利穷竭原则并没有达成一致意见,重视和研究权利穷竭原则成为迫切任务。本文试图以传统民法有关权利的基本理论以及知识产权的基本理论为切入点,并综合运用比较法等法律研究方法对权利穷竭和平行进口问题进行阐述与分析,并对我国的权利穷竭制度建设提出一定的建议。文章分为以下部分: 第一部分,对知识产权的一些特点或者法律特征进行了分析,这些特征是讨论知识产权权利穷竭无法绕过的前提和基础。深入分析这些法律特征,有助厘清有关知识产权权利穷竭争议的源头。在此基础上,对权利穷竭的含义和产生原因进行了分析,并认为权利穷竭是物权对知识产权的权利限制。第二部分,分别从法理学和经济学的角度论证了权利穷竭制度的合理性。在此基础上,第三部分对权利穷竭制度的适用范围进行了分析,在分析的基础上对权利的国际穷竭原则予以了理论上的支持。与此同时,还对与权利穷竭密切相关的平行进口问题进行了分析,通过对地域性原则和进口权的分析和批判,进一步支持了权利行进口问题中的适用。第四部分,对各行进口制度进行了比较分析。以及我国现行法律规定和司法实践,并在就完善我国知识产权权利穷竭制度提出了相关的修改建议。关键词:知识产权权利穷竭平行进口中图分类号:D9 万方数据 Abstract With the development of international trade,as welI as the internationaI protection of inteliectuaI property iS strengthened ceaselessly,the contradiction between inteIlectuaI property barriers and trade Iiberalization es increasingly exhaustion ofrightsdoctrine,as the Iimitation against interests between IPR holder and the public.
