文档介绍：摘要我国政府先后于1997年10月和1998年10月签署了《经济、社会和文化权利国际公约》、《公民权利和政治权利国际公约》,前者已由全国人大常委会于2001 年批准加入,后者也批准在即。在国际社会日益关注人权,人权的国际国内保护日趋完备的历史背景下,鉴于人权的国际国内保护日益成为世人关注的热点问题, 我国在这方面虽已尽了很大努力,但还存在诸多问题。本人选取了刑事立法这一突破点撰写学位论文,以国际人权两公约为依据,对我国刑事法律中人权保护的主要问题予以较为全面的研究,并通过深入思考,提出一些解决和改善的建议, 以期对我国的人权法制建设,贡献微薄之力。全文共分四个部分,分别阐述了人权与国际人权法概况;国涿人权两公约的产生及其主要内容:国际人权公约下我国刑事法律中的人权保护;重点探讨了我国刑法中的死刑限制问题,建立沉默权制度的问题,犯罪嫌疑人的律师辩护权的问题,刑事诉讼中被害人的人权保护问题。这些问题有的现行刑事法律中有规定但不完善或不具体,有的根本就没明确,直接影响和阻碍了人权的法律保护。笔者认为,对这些问题的解决,应在立法上予以高度重视。关键词:人权人权公约刑事法律 Abs仃act Our government signed the International Covenant on Economic,social and Cultoral Rights in1997,and International Covenant 0/1Cifiland Political Rights in formerⅥ啪ratifiedby mittee oftheNational People’ Congress in2001;the thebackground thathuman right is paid closeattentionintheworld andthepmtection hereofenhancesrapidly,human right protection es thefocusregarded athome and hasmade effortinthe regard,but there arestill writerchooses thecriminal legislation as thetisand ordance with two conventions takes detailed legal research on thehuman right protection inChinese Criminal ,the writer puts forward tosome measures tosettleandimprove thesematters thereof,in order topmmote thelegal constructionofhuman right ofChina.
