文档介绍：摘要新闻舆论监督是我国监督体系中一个重要的组成部分。在新闻事业飞速发展的今天,新闻舆论监督得到了党和政府的高度重视, 得到了人民群众的广泛关注和积极参与,在监督政府行为、官员言行、司法审判、公众人物等方面发挥出了特殊而重要的作用。但是, 从实践来看,新闻舆论监督在发挥其监督作用时又往往侵害到其他的合法权益,屡见不鲜的新闻官司就是一个佐证。一方面,新闻舆论监督的作用还没有得到充分发挥。另一方面,还没有得到充分发挥的新闻舆论监督就已频频伤及其他合法权益。那么,如何既发挥好新闻舆论监督的作用,又不至于侵害到其他合法权益呢?关键是将新闻舆论监督纳入法制的轨道。本文从公民的基本权利入手,界定出新闻舆论监督权是宪法规定的公民***、出版自由以及批评建议权等基本权利的必然延伸,具有基本权利的属性。同时,通过对新闻舆论监督主体的双重性、发挥作用的特殊性的分析,得出新闻舆论监督权具有准公权力性,是介乎公权与私权之间的一种权利。在此基础上,结合实践剖析新闻舆论监督屡屡侵犯其他合法权益的情形,提出对新闻舆论监督权进行规制,进而就如何规制新闻舆论监督权进行了初步的探讨。目的并不是限制新闻舆论监督权的行使,相反,是要通过法律的规范和制约。减少新闻舆论监督侵权现象的出现,保障好其他合法权益,使新闻舆论监督权更好地发挥作用。本文结合近来新闻舆论监督权的行使情况,特别是越位侵权的现状对如何规制新闻舆论监督权进行初步研究,从设置权利边界到侵权预防,从媒体的行业自律到新闻舆论监督发生侵权后的法律救济,从借鉴他国经验到完善本国立法,探索运用多种途径和手段, 对新闻舆论监督权进行规制。其中,, 有些是要通过今后的实践来体现的。关键词:新闻法制舆论监督新闻侵权规制 Abstract The news publicopinion supervision is ponent of our country supervisory ,the journalism develops SOrapidly thaithe news publicopinion supervision hasbeen concernedhighly by thePaay and governments ofalllevels,and got wide attention andparticipation by hasbeen playing a special and important role in thesupervision ofgovernment,official, justiee and ,in practice,thesupervision frequently infractsthe other’Srights when itworks,the frequent lawsuits of news infraction are examples one hand,the effectof the news public opinion supervision has not the otherhand,it infractsotherrights )how tomake the news public opinion supervision work efficiently and not toinfract otherrights?The mostimportant thing is toput itintothe trackofthe articlebegins with thepublic’s basicrights anddefines that thefight ofthenews public opinionsupervision istheprolongation of thepublic liberty ofwords,publication and suggestion defined by Constitution,and itis one ,through analyzing of thedualism of thenews publicopinion supervision and thespecialty oftheexertion,this article draws aconclusion thatthe right ofthe news public opinion supervision is ajust
