文档介绍：摘要非法持有毒品罪是毒品犯罪体系中的一个独立罪名,但由于毒品犯罪的特殊性和立法的简单及刑法理论学界对非法持有毒品罪研究的缺乏,司法实践中非法持有毒品罪的认定很难把握,为此,笔者拟通过对非法持有毒品罪进行粗浅探讨的方式,达到抛砖引玉之目的。本文先对非法持有毒品犯罪的社会危害及国际公约、国内外法律关于非法持有毒品犯罪的规定情况进行了概述,对国内外关于非法持有毒品犯罪的规定隋况进行了比较,探讨了非法持有毒品罪与走私、贩卖、运输、制造等其他毒品犯罪的关系、行为人目的的推定、吸食毒品行为的定性、刑罚设置等问题。然后,本文对非法持有毒品罪进行了界定,在非法持有毒品罪犯罪构成的客观方面和主观方面提出了“肯定陛要件”和“否定性要件”的观点,并就非法持有毒品罪客观方面、主观方面存在争议的一些问题诸如数量问题、持有方式问题、持有时间问题、曾经持有问题、未遂形态问题、主观方面的推定问题等谈了一些不成熟的观点。接着,本文对司法实践中存在争议的非法持有毒品数量的认定,包括毒品累计计算问题、共同持有问题、毒品纯度问题,及吸食毒品行为的处理、主动上交持有毒品行为的处理进行了探讨。最后,本文谈到了非法持有毒品罪的立法缺陷及其完善。关键词:非法持有毒品犯罪构成司法认定完善 Abstract Illegalpossession ofdrugs is allindependent crime among drug difflculty todetermine mission ofthiscrime because thatthefactsaboutthiscrimeiSvery simple inthecriminallaw ofPRC,and few cfwninal lawscholarspay attention tothiscrime in authorwants toimpel scholars tostudy onthiscrimethrough discussions ofthiscrime inthisthesis. Then thisthesisdiscusses suchissuessuch astherelationbetween this crimeand other drug crimes,the constitution ofthe crime ofillegal possession ofdmgs inPenal Code ofPRC,the definitionofthiscrime, thesevariousopinions abouttheobjective elements on thesediscussions,the authorpoints outthattheobjective elements of thiscrime includethepositive elements and thenegative elements,and SO doand thesubjective elements on theissueto determine thiscrime,thethesis discussesotherissuesSUchastheamount, thekindofpossession,the time need ofpossession,the once—existing possession ofdrags,possessing dragsjointly,taking thegravity ofpenalty ofthiscrime depends on theamount ofdrugs,the author points outthatwe should distinguish variouskindofpossession,and we should determine theamount of dmgs according to various circumstances.
