文档介绍：复旦大学硕士学位论文土地征收补偿制度姓名:王海林申请学位级别:硕士专业:宪法学与行政法学指导教师:潘伟杰 20080508 中文摘要随着我国城市化进程的加快,征收农村土地成为新增建设用地、扩大城市规模的主要途径。然而,在这场大规模“新圈地运动”的背后,出现了大量种地无土地、进城无工作、拆迁无家园、“非农"无保障、告状无门路的“五无农民一群体。城市边缘就像充满硝烟的战场,征地引发的矛盾随时可能激化。与此同时, 我国滥征土地数量之大触目惊心,直接危及国家的粮食安全和土地的合理利用。在农村土地征收中,突出问题之一为农村土地征收补偿制度。该制度影响对农村土地的保护、农民的利益和社会的安定。因此,有必要对土地征收补偿制度进行全方位的探讨。本文由四部分构成。第一部分引言对土地征收补偿制度的意义及研究文献、研究的方法和框架进行阐述。第二部分土地征收补偿的理论基础对土地征收制度的概述、土地征收补偿制度的宪法依据和理论基础和土地征收补偿制度的意义予以叙述。第三部分我国土地征收补偿的现状及问题对我国土地征收补偿制度范围、标准、方式以及程序中存在的问题研究。第四部分完善我国土地征收补偿制度的建议对土地征收补偿制度的原因分析、国外成熟经验的借鉴和对我国补偿费管理以及土地征收自然增值的研究。关键词:土地征收征收补偿缺陷中图分类号: ABSTRACT With eleration ofChina’s urbanization process,the expropriation of country e themain approach forthe new increaseof construction land andtheenlargement ofcity ,a large number of“fivenoes”peasants, who cultivatelandwhilehaving noland,enter thecity with nojob,remove with no homestead,e citizenswim no socialsecurity,or have no way toclaim their ri曲ts,e up behind thislarge—scale‘new enclosure movement’.The edge of citiesisjust likebattlefieldfullofsmoke ofgunpowder andtheconflictresulted fromexpropriation may atany moment ,the number of theexeessivelyexpropriated land isshocking by thesi曲t,which directlyendangers thesafety offoodsupplies andreasonable Bse oftheoutstanding problems intheexpropriation ofthecountry land pensation system ofland expropriation,which has allimpact on theprotection ofcountry land,the interest of peasants and thestability ,it isnecessary toconduct allall roundstudy pensation system oflandexpropriation.
