Only when the reluctant step by step to go to it 's time, must be managed to get one step down, only have struggled to achieve it. -- Guo Ge Tech . 页脚.. 毕业论文: 交通肇事逃逸致人死亡问题研究系: 职教部专业: 书记官学生: 宋丽指导教师: 程诗淇完成日期: 2010-6-7 .页眉. 页脚.. . 页脚.. 摘要交通肇事后“逃逸致人死亡”是指行为人肇事以后,不履行救助义务,弃被害人于不顾,驾驶车辆或者一起车辆逃离事故现场,致使被害人因没有得到及时救助而死亡。交通肇事后因逃逸致人死亡的行为人在主观上持两种心态,其与不作为的故意***有明确的区别。刑法判决中,刑法规定交通肇事后“因逃逸致人死亡”的,处七年以上有期徒刑。最高人民法院《关于审理交通肇事刑事案件具体应用法律若干问题的解释(2000 年11月10日)》规定“因逃逸致人死亡”是指“行为人在交通肇事后为逃避法律追究而逃跑,致使被害人因得不到救助而死亡的情形。”在理论研究和司法实践中对交通肇事致人死亡问题的认识上还存在较大争议。新刑法第 133 法规定:违反交通管理法规,因而发生重大事故,致人重伤、死亡或者使公私财物遭受到重大损失的,处3年以下有期徒刑或者拘役;交通肇事后逃逸或者其他特别恶劣情节的,处于 3年以上 7年以下有期徒刑;因逃逸致人死亡的,处7年以上有期徒刑。这里的“因逃逸致人死亡”是新刑法增加的相对于原交通肇事罪加重处罚的一个量刑情节。对于新增加的第三个罪刑阶段即“因逃逸致人死亡的,处7年以上有期徒刑”理论界与实践界一直存在着很大的争议。本篇论文从我国刑法的现行规定和司法解释入手,对交通肇事罪的构成及实践中存在的疑难问题进行研究,并对近些年理论界提出的一些观点进行了分析,提出了完善刑法规定的设想。关键词交通肇事;逃逸致人死亡;主观心态;司法规定;. 页脚..
