摘 要
随着社会经济的发展，特殊赠与如附条件赠与和附义务赠与被越来越广泛地使用，但由于人们对其特征不是很了解，在具体的使用过程中往往会出现诸多的问题。本文通过对附条件赠与和附义务赠与的概念、性质以及履行上的规则三个方面的比较来展开论述，对二者加以区分，从而弄清了附条件赠与和附义务赠与的本质区别在于二者的限定对合同生效的意义不同，附条件赠与的生效需要所附条件的成就，附义务赠与中所附义务的履行对合同的生效没有影响，从而为判断具体的赠与合同类型和解决了在当事人之间因特殊赠与合同发生纠纷时应该如何处理的问题，以免在具体的操作中出现误用混淆的情形。

ABSTRACT
With the development of social economy, special donations such as the donation subject to collateral obligations and the conditional donation is more and more widely used, however, people do not have a good understanding of its characteristics. Consequently, many problems appear in the process of concrete use. This paper progresses by comparing concept ,nature, and the rules in fulfillment of the donation subject to collateral obligations and the conditional donation, and tells these two donations apart, thus making it clear that the their essential difference lies in their limits to the contract’s coming into effect. The conditional donation will only come int
