摘要：从《合同法》诞生并实施，对社会主义经济秩序起 到了重要的维护作用，本文将重点介绍效力待定合同。效力 待定合同顾名思义，是指合同虽成立，但欠缺生效的构成要 件，需有补救措施方可有效。本文第一部分结合司法解释阐 述效力待定合同的概述，以及与其他合同的区别。第二部分 重点分析限制行为能力人订立的合同概述、限制行为能力人 的法定代理人追认权与相对人的撤销、催告权。第三部分主 要介绍无权代理订立的合同概述，无权代理订立合同的效力 以及狭义无权代理与表见代理区别。第四部分探讨无权处分 订立合同的概述以及合同的效力，无权处分订立的买卖合同 不影响合同效力的区分原则。加强对合同效力待定问题的研 究，不但具有极为重要的理论意义，还有很强的现实意义。
