文档介绍:摘要抵押权制度是担保制度的重要组成部分,在担保物权中处于核心位置。在我国经济发展的进程中,抵押制度作为交易中经常采用的担保方式,对促进交易,保障债权实现和债务的履行,增强主体信用,预防和减少不必要的交易风险,具有十分重要的作用。我国自1995年《担保法》颁布以来,学界对抵押权的讨论就没有停止过。《担保法》对抵押作了专门规定,但由于立法疏漏以及法条规定得较为原则,使得不少问题尚待从理论上进一步探讨,从制度上予以完善。笔者对抵押权物上追及力、抵押权物上代位性、动产抵押权公示制度、重复抵押、当事人自行约定抵押期间、建设工程价款优先权及相关银行抵押权的保障等抵押权的几个核心问题进行研究,希望能够达到抛砖引玉之效果,对我国的抵押权制度的立法完善有所裨益。关键词:抵押权、物上追及力、重复抵押、在建工程抵押 Abstract System ofright tomortgage istheimportant constitutive part of securitysystem,which liesin allessentialposition inrealri曲ts for the course ofeconomic development of oBr country, hypothecation system,as afrequently adopted method ofsecurity in transactions,plays theveryimportant rolesinpromoting transaction, safeguarding the realization of creditandperformance of debt, strengthening subjects’credibility and preventing and decreasing unnecessary transactional promulgated Law on Security in theoretical circlehasn’tstopped discussing about啦ht on Security has specially stipulated mortgage,but due tothelegislativeloopholes and because thelegal provisions are very inprinciple,a lotofquestions need tobeftlrther Drobed into血theory and tnbeperfected insystem...The author expounds such essential questions ofhypothecation as,force of recourse on property ofhypothecation,subrogation 0n property of hypothecation,public SUmlTIOnS system ofhypothecation ofmovable property,double hypothecation,period of mortgage the parties contract bythemselves,preference ofsum ofconstructive proiect and safeguardofhypothecation ofrelatedbanks,and theauthorhopes that more andmore valuable opinions callbefollowed andthe studieswill be beneficial for the legislative perfection ofsystem ofright to mortgage ofourcountry.
