房屋建筑工地和市政工程工地用起重机械的改造的安全监察适用本规定。房屋建筑工地和市政工程工地用起重机械的安装、使用的监督管理不适用本规定。
第四条 （监察职责分工）国家质量监督检验检疫总局（以下简称国家质检总局）负责全国起重机械安全监察工作，县以上地方质量技术监督部门（以下简称地方质监部门）负责本行政区域内起重机械的安全监察工作。
第五条（安全责任）起重机械生产、使用单位应当对起重机械安全性能和安全使用承担相应责任。单位主要负责人对本单位起重机械的安全全面负责。
第六条（检验检测机构管理）起重机械的检验检测机构，必须经国家质检总局的核准，方可从事在核准的检验项目范围内起重机械及安全保护装置的型式试验、监督检验、定期检验工作。使用单位设立的检验检测机构，经国家质检总局核准，在核准范围内从事本单位的起重机械定期检验工作。
房屋建筑工地和市政工程工地用起重机械的检验检测机构，应当依照条例规定，经国家质检总局核准。
第七条（作业人员管理）从事起重机械的作业人员，应当按照《特种设备作业人员管理办法》执行。
第八条 （鼓励）各级质量监督部门在实施起重机械的安全监察时，应当鼓励采用先进技术和科学的管理方法。
