文档介绍：1 内容摘要最近一段时间以来,保姆虐待儿童、教师虐待儿童、医院护士侮辱婴儿等各种形态的虐待儿童事件被相继曝光后,一再的挑战了民众情感的容忍底线,尤其是在温岭蓝孔雀幼儿园教师颜艳红虐待儿童的照片被曝光后,引起了民众的极大愤慨和不满,纷纷表示必须要严惩这种恶劣的行为,并给予这种道德败坏的当事人法律惩治。但是我国是法制国家,必须要依法行事和依法处置,不能接受这样的“舆论审判”。面对不同的主体、不同的对象、不同形式的虐待事件,加之法律本身的抽象性、局限性、滞后性,暴露出了刑法对此问题规制的空白和缺失,于是舆论矛头便直击体制机制的缺陷和政策法律的乏力。如何用法律手段保障儿童的基本权益,是一个需要探讨、急待解决的问题。文章拟通过对虐童事件的分析,提出完善的立法建议,以有效的打击虐待儿童的行为,最大限度地保护儿童的权益,进而维护社会和谐,体现社会主义法治精神。笔者将全文分为五个部分:首先第一部分为虐童事件的回顾及行为定性。将近年来的虐童事件简要回顾后,在结合各国虐童行为定义的基础上提出我国虐童行为的界定意见及类型,便于司法实践操作;第二部分讲述了虐童行为的刑法规制之困境及处理分歧。依据现实虐童事件争论的焦点—虐童行为的定性问题,得出我国现行刑法无法规制虐童行为的困境。但是为了解决该困境,法学家们提出了可行的方式:增设虐待儿童罪、修改虐待罪、保持法律稳定性(现有法律可以规制)三种,最后笔者陈述自己的观点;第三部分是讲我国现行刑法难于规制虐童行为的解析。通过该部分我们得知在受到传统“棍棒教育”的思想影响下加之现行刑法的立法缺陷,以及社会资源的分配不公等因素下,共同导致了现行刑法难以规制的现状;第四部分则是简要概述了西方国家及其他地区防治虐童的立法保护措施,通过介绍美国、日本、我国香港地区立法保护的措施,希望我们可以借鉴、引用。最后是笔者对完善虐童行为刑法保护与配套制度的建议。在学****国外的经验基础上,具体提出立法、制度及社会等方面的建议。关键词:虐童行为;虐待罪;刑法规制 1 Abstract Nannies, teachers of child abuse and child abuse hospital nurse humiliate baby various forms such as child abuse event was essively after exposure, repeatedly challenged people tolerate the bottom line of emotion, especially in possessing blue peacock kindergarten teachers Yanyanhong’sphoto of child abuse was reported, aroused great indignation and discontent among the public, have said must severely punish the bad behavior, and the moral law to punish the parties.
