摘要
动产抵押是抵押人以不转移占有的动产对债权人的债权进行担保的一种担保方式
动产抵押权属于物权的范畴所以动产抵押权需要一种公示方式世界上引进动产抵押
的国家都以登记作为动产抵押权的公示方法
抵押登记行为是综合了民事行为和具体行政行为两种性质的行为我国目前所采取
的是由多个部门分头管理分头登记的登记方式在登记地点的选择上本文认为以抵
押物所在地的有关的登记部门办理登记是比较合理的选择登记机构受理登记申请应
实行形式主义的审查方式而不宜采取实质主义的审查方式登记有可能出现错误登记
在登记错误的情况下应该区别造成登记错误的原因来追究有关责任人的责任
我国法律确定登记的抵押权具有对抗善意第三人的效力对于第三人的理解不应该
仅仅局限于第三人的主观因素还应该考虑其权利性质登记对抗力的时空间范围在尊
重当事人意思自治的私法理念下不必由法律做出强制性规定我国动产抵押标的物范围
是不受限制的由此可能导致登记后的抵押物被抵押人处分后抵押物灭失而损害抵押
权人利益的情形对于此问题可以通过强化抵押权人对抵押物的监管和对抵押人与抵
押物有关的生产经营活动的介入权来解决

Abstract
The chattel mortgage is to mortgage a person by doing not transfer a kind of
guarantee that movable property's legal right to creditor of occupancy carries on
chattel mortgage power belongs to the category of real right, so the
chattel mortgage power needs a kind of Mr. to show a way, in the world usher in the
nations of chattel mortgage all by the register is Mr. of chattel mortgage power to show.
