北京中级人民法院于1994年5 月受理了我国第一起商标反向假冒案，1998年6月作出了判决。 该案例曾在知识产权界引起了一场不大不小的讨论。有人认为“似乎难以自圆其说”（注：郑成思主编，《知识产权研究》，第1卷，中国方正出版社1995年版。）， 还有人认为这“在国外是老问题，并且是已经解决了”（注：郑成思著，《知识产权论》，法律出版社，1998年版，第218页。）。 笔者无意于在本文中对此作出评论。美国
