征地拆迁工作管理办法（试行）
为规范茂湛铁路公司建设征地拆迁工作行为，明确职责范围，依法、有序、快速地完成征地拆迁任务特制定本办法。
第一条 茂湛铁路公司建设征地拆迁工作必须严格遵守国家的法律、法规，以全面落实铁道部与广东省人民政府《关于加快铁路建设协调小组第八次会议纪要》、《关于印发〈茂名至湛江铁路建设协调会议纪要〉的通知》为总工作原则，认真执行茂湛铁路有限责任公司（下称茂湛铁路公司）分别与茂名市、湛江市签订的《征收土地和拆迁工作协议》，以及各参建单位签订的设计、施工、监理承包合同，紧紧依靠当地各级人民政府，依法保护铁路建设和沿线人民群众的合法权益，按照和谐建设的理念努力为铁路施工创造一个良好环境。
第二条 茂湛铁路建设工程投资由铁道部、广东省、茂名市、湛江市分别出资，征地拆迁工作统一由市、县人民政府负责组织实施。
第三条 茂湛铁路建设用地以施工图设计文件为基础，含经批准确定的永久性建设用地、县级以上公路改建工程用地及补充设计和变更设计增加的永久性用地。经勘测定界后的永久用地，按规定办理相关用地手续。

第四条 茂湛铁路建设用地范围内需要拆迁的所有建筑物，经路、地双方共同详细调查，确认类别、数量后，由当地人民政府主管部门组织按期拆除。
第五条 茂湛铁路建设的征地拆迁具体工作，履行与当地政府签订的《征收土地和拆迁工作协议》条款。茂湛铁路公司所有参建单位，应按照设计、施工和监理合同实行各负其责、相互配合的管理机制。
第六条 茂湛铁路公司负责协调工作。
