论医疗行为的判断标准

　　内容提要: 医疗事故通常是医师在施行医疗行为过程中因存在过失而造成的。医疗行为是否存在过失是医方承担医疗损害赔偿责任的前提和基础 ,因此通过对与医疗行为密切相关的问题进行论述和分析 ,为司法实务界公正、合理解决医患纠纷提供可参考的理论依据 ,以促进医疗卫生事业在良好的社会环境下得以健康有序的发展。
　　在医患法律关系中,某种医疗行为之所以被认为是医疗损害,其原因在于对患者人身损害的结果是由不当的医疗行为造成的。如果医师在施行医疗行为过程中履行高度的注意义务,就不可能有医疗损害事件的发生。当医疗行为造成医疗损害需要追究医方的损害赔偿责任时,必须确认其医疗行为是否存在过失、过失与损害结果之间是否有因果关系等问题。由于医疗行为范围相当广泛,而且在医学科学的不断进步、发展和变化的新的现代社会条件下,对医疗行为性质的认定具有一定的难度。对此,应当依据当时的医学水准、地域差异、人们生活水平以及医疗卫生思想的普及等因素进行综合判断。亦即在认定是否存在医疗过失时,必须考虑医疗行为的特殊性。因此,对医疗行为的内涵和外延作出正确的界定,是正确认定医方是否承担医疗损害责任的关键。这对于充分保护医患双方的合法权益,公正、合理地解决医疗损害事件,促进医学科学水平的发展,最终提高民众的生活质量,具有非常重要的现实意义。
