论离婚诉讼中的反诉
内容提要：反诉是现代民事诉讼中一项非常重要的制度，它在平等地保护双方当事人的合法权益、避免产生相互矛盾的判决、实现诉讼经济等均有裨益，因此现代各国的民事诉讼中几乎都规定了这一制度。
我国也不例外，在民事诉讼中明确规定了反诉制度。但离婚案件作为基层法院一种主要的民事纠纷，在审理的过程中是否也像普通的民事案件一样同样适用反诉制度呢？司法实践中却存在一些不同的看法，有人认为：婚姻纠纷案件系混合之诉，在任何情况下均应围绕夫妻感情是否破裂、子女抚养、财产分割、困难补偿、损害赔偿问题进行审理，因此，没有提起反诉的必要。有人则认为，离婚案件应该存在反诉的问题。其理由是：根据《中华人民共和国民事诉讼法》第一百零八条关于起诉条件、第五十二条关于反诉条件、《婚姻法》第四十六条关于损害赔偿的相关规定，确定离婚诉讼中被告的反诉有利于保护被告，实现当事人的诉权平衡，且离婚诉讼中的反诉
