国土资源执法监察巡查工作规范
(试行)
第一章 总则
第一条 为提高执法效能，实现对国土资源违法行为的“早发现、早制止、早处置”，促进地方国土资源行政主管部门依法组织、有效开展巡查工作，切实履行“保障发展，保护资源”职责，根据国土资源法律法规及有关规定，制定本规范。
第二条 本规范所称巡查，是指国土资源行政主管部门及其派出机构通过巡回检查的方式，及时发现本规范所列国土资源违法行为，依法予以制止和报告的工作制度。
第三条 巡查工作应当遵循依法、及时、有效的原则。
第四条 地方各级国土资源行政主管部门及其派出机构在本行政区域内组织实施巡查工作适用本规范。
第二章 职责
第五条 省(区、市)国土资源行政主管部门行使下列巡查职责：
(一)组织、指导本辖区巡查工作，制定巡查工作实施办法；
(二)对下级国土资源行政主管部门巡查工作的开展情况进行监督检查；

(三)对下级国土资源行政主管部门巡查工作责任制的落实情况进行考核；
(四)每年向本级人民政府和国土资源部报告巡查工作开展情况，同时抄报派驻地方的国家土地督察局。
第六条 市(地、州)国土资源行政主管部门行使下列巡查职责：
(一)组织、指导本辖区巡查工作，制定巡查工作实施方案，报上一级国土资源行政主管部门备案。工作实施方案应当明确巡查的任务、目标、基本要求等；
(二)对下级国土资源行政主管部门巡查工作的开展情况进行监督检查；
(三)对下级国土资源行政主管部门巡查工作责任制的落实情况进行考核；
(四)每季度向本级人民政府和上一级国土资源行政主管部门报告巡查工作开展情况。
第七条 县(市、区)国土资源行政主管部门行使下列巡查职责：
(一)组织、实施本辖区巡查工作，制定季度工作计划，报上一级国土
