文档介绍：I 论家庭暴力的成因及对策摘要家庭暴力作为古今中外家庭中常见的、具有普遍性的丑恶现象, 是一个全球性的问题。虽然社会文明程度提高、人们的法律意识增强,但家庭暴力在我国却有不减反增的趋势,严重损害了正常的家庭关系,现已成为危害社会稳定的重要因素。预防和制止家庭暴力是一个综合性的社会系统工程,不仅需要立法,也需要相关部门的配套措施,更需要人们思想观念的转变。针对我国目前反家庭暴力的理论研究与实务操作脱节的情形,本文着重从家庭暴力的成因、反家庭暴力的法律现状入手来探讨家庭暴力的防治对策。笔者借鉴国外家庭暴力防治实践的成功经验,结合我国现有反家庭暴力的制度体系,提出反家庭暴力立法的必要性和可行性,并对我国现有反家庭暴力法律法规的完善、反家庭暴力网络的建立提出了若干意见。本文主体分为三章:第一章,阐述家庭暴力的本质,分析家庭暴力的内涵、特点及表现形式。第二章从思想文化、社会经济、国家政策、社会公众态度、法律法规方面剖析了家庭暴力产生的原因;阐述家庭暴力的危害,家庭暴力严重破坏了社会的组成细胞——家庭,家庭暴力侵犯了受害人的人身权利,是诱发女性犯罪的重要原因,严重危害社会稳定。第三章探讨我国家庭暴力的防治对策,提出了具体的立法建议和应对措施:第一,在制定家庭暴力防治法的同时, 完善已有的相关法律法规, 以保证法律的协调性和系统性。第二,各方协调,严格执法,以联合防治家庭暴力。第三,建立反家庭暴力的社会网络,论述社区应发挥的重要作用,以及新闻媒介的宣传、社会性别的培训、国家政策的制订等抑止家庭暴力的积极作用。关键词: 家庭暴力,家庭暴力防治法,成因,对策 II THEORY OF FAMILY VIOLENCE, CAUSES AND COUNTERMEASURES ABSTRACT Family violence as ancient and modern, Chinese and foreign mon, the universal evils,is a global problem. Although social civilization improve , the legal consciousness of people increase, family violence inour country has not decreased the trend of increase, serious damage to normal family relationships, has e a danger to social stability of the important factors.
