第一章 总 则
1. 目的
为保护公司的知识产权，规范公司知识产权管理，调整员工在产品研发、产品设计及其他工作中做出的发明创造或其他智力劳动成果，实现公司与员工双赢的目的，根据《专利法》、《商标法》、《著作权法》、《反不正当竞争法》、《计算机软件保护条例》、《合同法》等法律法规定的相关规定，结合公司的实际情况，制定本规定。
2. 适用范围
本规定适用于江苏****科技有限公司全体员工。
3. 定义和保护范围
本规定所称的知识产权是指员工在执行公司工作任务过程中，或虽非执行工作任务但利用公司名义或主要利用公司的物质技术条件完成智力劳动成果时所取得的权益。
智力劳动成果是指经过创造性智力劳动获得的各种实验研究技术改进和技术创新成果、实验原始记录和各种数据、文件材料、图片、技术资料、实验样品、设计图纸及其说明、各种声像材料、程序软件、文学作品、美术摄影作品及其他作品
