制度也在不断地发生着变化，从法律方面，立法者更是不断地对其进行发展和完善。
（一）、过错赔偿原则。 新婚姻法中规定今后因重婚，有配偶者与他人同居，实施家庭暴力，虐待、遗弃家庭成员等原因导致离婚的，无过错方有权请求损害赔偿。还规定离婚时一方隐藏、转移、变卖、毁损夫妻共同财产，或伪造债务企图侵占另一方财产的，分割夫妻共同财产时，对隐藏、转移、变卖、毁损夫妻共同财产或伪造债务的一方，可以少分或不分。离婚后，另一方发现有上述行为的，可以向人民法院提起诉讼，请求再次分割夫妻共同财产。
（二）、无效婚姻原则 家庭是社会的细胞，而婚姻是构成家庭的基本要素。《婚姻法》中无效婚姻是指建立婚姻关系的双方当事人违反婚姻法的有关规定，不履行法定的结婚登记程序而建立的婚姻关系，这种婚姻关系是不受法律保护的无效婚姻。如重婚、有禁止结婚的亲属关系、婚前患有医学上认为不应当结婚的疾病，婚后尚未治愈、未到法定婚龄等。无效婚姻自始无效，当事人不具有夫妻间的权利和义务，同居期间所得财产，由当事人协商处理，协商不成，由人民法院根据照顾无过错方的原则判决
