山西省道路运输条例
(2010年9月29日山西省第十一届人民代表大会常务委员会第十九次会议通过)
第一章 总则
第一条 为保障道路运输和人民生命财产安全，保护道路运输各方当事人的合法权益，维护道路运输市场秩序，根据《中华人民共和国道路运输条例》和有关法律、法规，结合本省实际，制定本条例。
第二条 在本省行政区域内从事道路运输经营、道路运输相关业务和道路运输管理活动，适用本条例。
本条例所称道路运输经营包括道路旅客运输经营(以下简称客运经营)和道路货物运输经营(以下简称货运经营)。道路运输相关业务包括道路运输站(场)、机动车维修、机动车综合性能检测、机动车驾驶员培训、汽车租赁、物流服务等业务。
第三条 县级以上人民政府应当坚持统筹城乡道路运输一体化原则,发展道路运输事业。
道路运输管理应当坚持依法、公开、公平、公正、高效、便民的原则。
从事道路运输经营和道路运输相关业务的，应当依法经营、诚实信用、公平竞争、安全便捷、环保节能。
第四条 县级以上人民政府应当根据当地经济和社会发展的需要，制定本行政区域道路运输发展规划，并组织实施。
县级以上人民政府应当采取措施，扶持农村客运和物流发展。
第五条 县级以上人民政府交通运输主管部门负责组织领导本行政区域内的道路运输管理工作。
县级以上道路运输管理机构负责具体实施道路运输管理工作。
县级以上人民政府发展和改革、公安、财政、国土、住房和城乡建设、规划、工商、环保、安监、质监、旅游、价格等部门，应当按照各自的法定职责，做好道路运输管理的相关工作。
第六条 省人民政府应当将道路运输管理经费列入财政预算，统一预算、统一管理、专款专用。
县级以上人民政府应当将超限超载源头治理工作经费列入本级财政预算。
