各级人民政府和规划、房管、财政、物价、工商、经贸、公安等有关部门应当依照本办法规定，互相配合，保证城市房屋拆迁管理工作的顺利进行。
    土地行政主管部门依照有关法律、法规的规定，负责与城市房屋拆迁有关的土地管理工作。
第二章  拆迁管理
    第六条  城市房屋拆迁应当遵循下列程序：
    (一)对拆迁项目进行评估；    
    (二)拆迁人向房屋拆迁管理部门申领房屋拆迁许可证；
    (三)房屋拆迁管理部门发布拆迁公告；
    (四)拆迁人与被拆迁人或者拆迁人与被拆迁人及房屋承租人订立书面拆迁补偿安置协议；
    (五)拆迁人按照拆迁补偿安置协议进行补偿安置；
    (六)实施房屋拆除。
    实施房屋拆迁施工的时间，应当自拆迁公告公布之日起不少于30日。对华侨和其他居住在国(境)外的人员，拆迁人应当书面告知实施房屋拆迁的时间，拆迁时间应当相应延长。但拆迁人与被拆迁人对实施房屋拆迁的时间另有约定的，从其约定。
    第七条  申领房屋拆迁许可证的，应当向房屋拆迁管理部门提交下列资料：
    （一）建设项目批准文件；
    （二）建设用地规划许可证；
    （三）国有土地使用权批准文件；
    （四）拆迁计划和拆迁方案；
    （五）办理存款业务的金融机构出具的拆迁补偿安置资金情况证明
