(二)依法参加社会保险、按规定履行缴费义务(即参加社会保险人数至少达到县政府规定的行业最低参保率要求,近三个月没有出现无故欠缴社会保险费的情况),并全员签订劳动合同、办理就业登记；
(三)2008、2009年内不裁员或基本不裁员；
(四)近两年来没有出现无故拖欠工资的行为；
(五)已制定在岗培训、轮班工作、协商薪酬等稳定员工措施的；
(六)生产经营活动符合国家、省及我市产业和环保政策(国家、省限制的行业和企业除外)。
帮扶的重点是就业容量大、就业贡献率高的企业，县政府确定的“工业30强企业”优先享受本意见规定的各项帮扶政策。
申请认定困难企业的，应填报《享受帮扶政策的困难企业认定申请表》(见附件)，向县经贸部门提出申请，经县经贸部门审核后报县劳动和社会保障部门汇总，由县劳动保障部门会同经贸、财政、地税等部门研究确定，报县政府批准。
二、具体帮扶措施
(一)允许困难企业在一定时期内缓缴社会保险费
根据浙劳社就〔2009〕6号文件精神，允许暂时无力缴纳社会保险费的困难企业缓缴2009年度内应由企业缴纳的社会保险费，缓缴期限最长不超过6个月。具体程序为：申请缓缴的困难企业应向主管地税机关提出书面申请，县地税部门会同县劳动保障、财政部门审核，并报县政府批准后实施。申请缓缴的困难企业应与主管地税机关签订缓缴及补缴社会保险费的协议，地税机关可以依法要求企业提供担保或抵押。经批准缓缴期间，企业应继续按月申报应缴的社会保险费，代扣代缴职工个人应缴的社会保险费，职工缴费年限连续计算，缓缴的社会保险费不加收滞纳金。
