1、以利润投资是指以外商投资企业的净利润投资，它不同于有关外商投资企业法中规定的外国投资者用分得的利润在中国再投资。在主体上，前者是外商投资企业，后者是外商投资企业的外国投资者；在投资性质上，前者属于内资投资，后者则属于外资投资；在税收待遇上，前者不能申请退还已缴纳的所得税，而后者则可以申请退还40％的已缴纳的所得税。
