文档介绍：[中文摘要]本义从一l:地7II:收的法胛分析入于,以七地征收必须毖j二公共利益之需要、必须符合订:当的程拜、必须给jr合理补偿二个正当性要件为}I{发点,深刻沦述了各团(地区)土地祉收制度的情况及发展趋势,并采用比较研究的方法, 找出了我固’t地{d:收制度。j其它发达国家(地区)在立法及实践等方面存在的问题和差距,对我国上地征收制度存在公共利益界定刁i清、幂罕序缺失、补偿不合理等问题进行了深入剖析,同时,借鉴美国、德刚、f1本等发达囝家和我国台湾、香港等地比较完善的:卜地征收法律制度,以及众多学者近年来在我附土地征收方面的研究成果,提出完善我田七地征收的理论构想。在土地征收公益目的方面, 提出了科学界定上地征收的公益Fl的、开放集体土地~级市场的解决办法:在土地征收程序方访i,通过建立土地征收公益目的的认定程序、事前补偿程序、听证制度、土地原所有人买(收)回程序、土地征收争议的裁决机制等,从制度上探索保证失地农民更多的参与权、知情权和拒绝上地征收的权利;在土地征收补偿方面,提出了适合我国市场经济发展的补偿原则,并对失地农民作出了一系列的安排,以保征失地农民的生洒质量不会下降并自‘所提高。关键渊:土地征收公益目的正当程J孚合理补偿 Summal’Y From jurisprudential analysis of land expropriation,this paper discussed other countries’systems and developing trend of Land expropriation;found out the differences inlegislation and practice between in China and in other countries of land expropriation parative method;dissected the problems of defining public advantages,being short ofprocedures and pensation..
