文档介绍：摘要法治社会中,法律所拥有的权威主要来自于职业法官对法律的解释与运用。法官职业化是对法官职业品质的具体要求,法官职业化的特性,主要包括:尊崇法律、专业化、类型化、独立性、消极性、经验化等等。但是,长期以来我国未形成职业化的法官群体。2002年7月, 最高法院在全国法院队伍建设工作会议上首次明确提出了“法官职业化建设”的总体目标。但在实践中法院特别是基层法院的职业化进程却遭遇到了层层阻力,这些阻力既有体制之内的,如法官身份的不确定性、法官管理地方化、法官管理与司法权力的行政化、法官选任的低质化等等:也有体制之外的,如法官职业化与社会化的冲突、法官经济保障不力等等。笔者认为中国基层法院职业化改革要走出困境,首先,应当构建司法独立体制,它包括司法的外部独立与内部独立;其次,建立符合职业化取向的法官遴选与培;.JilN度;再次,为法官独立提供制度、物质的支持并构建统一的职业道德规范体系与法官道德约束机制。但在体制改革相对滞后的情况下,基层法院职业化改革应充分考虑法院与法官在国家政治权力结构中的地位、功能以及中国的国情等等,审慎地推进。特别应当着力于完善法院内部管理机制,改善法官裁判的内部环境,提高法官业务技能与职业道德水准。关键词:法官职业化理念制度困境出路 Abstract Inthelegalsociety,the authority owned by lawmainly embodies in the professional judges’explanation and application of professionalization ofjudges isthespecificdemand fortheprofessional quality characters of theprofessionalization ofjudges mainly includes as follows:Reverence for the law,specialization categorization、independence、passiveness、emplicalization and SO on.
