文档介绍：农村土地承包经营权流转问题研究 I 内容摘要农村土地承包经营权流转是完善土地承包保经营权制度的关键,而土地承包经营权制度在我国土地立法中的核心地位,决定了农村土地承包经营权流转研究的重要性。本文主要是对以家庭承包方式取得的承包经营权的流转进行研究,目的是通过对土地承包经营权流转的研究, 探讨完善我国承包经营权流转制度的方法, 实现土地承包经营权的有效流转, 实现土地的规模化经营,提高农业生产率。本文主要通过比较分析法、实证分析法、历史分析法等方法进行研究,在论述我国相关的政策、法律及社会现状的基础上,综合理论界的相关争议,提出解决的建议。文章分为四部分,第一部分,主要介绍土地承包经营权的涵义、性质以及土地承包经营权流转的含义、意义,提出承包经营权物权化,以及物权化对土地承包经营权流转的意义;第二部分主要论述土地承包经营权的几种主要流转方式的内容及条件,特别是对抵押、出典、继承等有争议方式进行了论述;第三部分主要论述了土地承包经营权流转中主体的地位和作用,主要是论述了农地所有者在流转中的作用和承包经营权人在流转中的权利和义务;第四部分是从微观和宏观两个方面论述了土地承包经营权流转过程中的问题和对策,这是本文分析的关键,也是本文的目的所在。本文在主体、流转方式、制度建设等方面提出了完善土地承包经营权流转的建议,是本篇文章的创新点重点所在。关键词: 土地承包经营权, 土地承包经营权流转, 土地立法河北经贸大学硕士学位论文 II Abstract The Circulation of the management right of rural land contracting is the key to perfect the system of the right of rural land contracting. And the right of rural land contracting is the core of rural land law system. So the circulation of the manageme nt right of rural land is very important. The purpose of this article is that form researching the circulation to pe rfect the system of the right of rural land contracting, carry out the circulation effectively, realizing the scale management of agricultural, improve the productivity. This text mainly passes the more analytical method, substantial evidence analysis method, history analys is method etc. In the base of researching our country foundation of the related policy, law a nd the society present condition, we got the method to perfect the system .The ar ticle is divided into the four pa rt.
