文档介绍:1 内容摘要在构建和谐社会的价值理念下,建设一个没有歧视、多元的社会是应有之义,人人共同享有平等机会。作为特区的香港,以消除歧视、构建包容共济的社会为发展目标, 促进社会人士关注、认识和接纳平等机会和多元化的价值理念,在反歧视方面有很多成功的经验。本文分为五个部分论述,全面介绍和评述了香港地区反歧视法制,以期获得借鉴经验,从而完善我国反歧视法律制度。第一部分考察了香港反歧视立法的背景。以国际大环境为依托探讨香港反歧视立法的促成动因,主要包括了经济因素、殖民时期的政策影响和国际环境影响。第二部分梳理了香港反歧视立法进程。从反歧视立法发展初期到迅速发展时期,再到发展前景,以时间为脉络介绍了香港权利平等保护的历程。由零散的反歧视法律规定到集中性制定反歧视条例,再就现行条例进行全面检讨,更新和理顺各条例。第三部分介绍了香港反歧视法的制度安排。试图以香港反歧视的法律规范、组织机构以及反歧视的实践运用来呈现其反歧视法的丰富内容和独具匠心之处。香港反歧视的四部条例(1995年颁布的《性别歧视条例》、《残疾人歧视条例》,1997年通过的《家庭岗位歧视条例》和2008年通过的《种族歧视条例》)是香港平等机会委员会(负责执行反歧视的专门机构,以下简称平机会)开展反歧视工作的法律依据。平机会以事实为根据,以法律为准绳处理相关歧视投诉,化解矛盾,致力于消除歧视。第四部分对我国香港反歧视法制予以评述。首先介绍香港反歧视法本身存在的问题, 即保障范围过窄。其次从平机会的工作开展情况入手,分析平机会的不足之处。第五部分主要是香港反歧视法对内地的启示。结合我等保护权利制度之所长,寻找适合我国反歧视的法律路径。关键词:歧视;香港反歧视法;香港平等机会委员会 1 Abstract From the perspect of building a harmonious society, the construction of a non-discriminatory, pluralistic society is the proper contents that everyone can enjoy equal a special administrative region, Hong Kong aims for discriminate elimination and mutually development ,as well as the promotion of attention, recognize and acceptance of the society towards equal opportunities and multi-values which wins lots of essful experience in the anti-discrimination area. This paper is divided into five parts that introduce and analysis the Anti-Discrimination Legal System comprehensively in Hong Kong area in order to gain experience, so as to improve the system of anti-discrimination laws of China. The first part investigates the founding background of Hong Kong anti-discrimination legislation.
