一、法律解释的主观性释义
人是有目的有意识的主体，这些目的或意识深藏于人的内心世界。人虽然也靠感知认识世界，但感知只能接触人的外在部分，无法深入人的内心世界，只有通过理解和解释才能作出正确的判断。相对于许多自然界的现象来说，人的活动是有目的的，对这些活动应当进行理解才能把握，法官在司法过程中判断人的行为和事件同样需要通过理解和解释。
