第七条 价格主管部门应当会同物业管理行政主管部门，综合考虑物业公共服务平均成本、最低工资标准调整幅度以及居民消费价格指数变动情况，依据本地区物业服务等级标准制定相应的普通住宅物业公共服务费的基准价与浮动幅度，并向社会公布。
价格主管部门应当会同物业管理行政主管部门每三年内对物业服务等级标准以及相应的基准价与浮动幅度进行评估，并根据评估结果适时调整。
已对应物业服务标准分类分项分级收费管理的，应当依据本条规定制定、评估基准价及浮动幅度，并向社会公布。
第八条 在业主、业主大会选聘物业服务企业前，普通住宅物业的建设单位应当在价格主管部门公布的政府指导价范围内，通过公开招投标或协议方式，选聘具有相应资质的物业服务企业，并在前期物业服务合同中约定服务内容、服务标准以及收费标准。建设单位与物业买受人签订的房屋买卖合同，应包含前期物业服务合同约定的内容。前期物业服务费未在房屋买卖合同中约定的，由建设单位承担。前期物业服务合同由物业服务企业向当地价格主管部门、物业管理行政主管部门备案。
业主大会、业主代表大会或物业管理委员会〔以下统称业主大会〕成立前，普通住宅物业公共服务收费标准因服务成本变化需要调整，或政府指导价标准调整的，物业服务企业应在街道办事处〔乡镇人民政府〕组织、指导与监督下，公开真实、完整、有效的物业服务成本信息，向业主征询意见，经专有部分面积占建筑物总面积半数以上的业主且占总人数半数以上的业主同意，形成业主共同决定，在政府指导价范围内实施调整并约定执行。
