第八条 在业主、业主大会选聘物业服务企业前，普通住宅物业的建设单位应当在价格主管部门公布的政府指导价范围内，通过公开招投标或协议方式，选聘具有相应资质的物业服务企业，并在前期物业服务合同中约定服务内容、服务标准以及收费标准。建设单位与物业买受人签订的房屋买卖合同，应包含前期物业服务合同约定的内容。前期物业服务费未在房屋买卖合同中约定的，由建设单位承担。前期物业服务合同由物业服务企业向当地价格主管部门、物业管理行政主管部门备案。
业主大会、业主代表大会或物业管理委员会（以下统称业主大会）成立前，普通住宅物业公共服务收费标准因服务成本变化需要调整，或政府指导价标准调整的，物业服务企业应在街道办事处（乡镇人民政府）组织、指导与监督下，公开真实、完整、有效的物业服务成本信息，向业主征询意见，经专有部分面积占建筑物总面积半数以上的业主且占总人数半数以上的业主同意，形成业主共同决定，在政府指导价范围内实施调整并约定执行。

第九条 物业公共服务收费可以采取包干制或者酬金制等形式，具体收费方式由物业服务合同约定。
包干制是指由业主向物业服务企业支付固定物业服务费用，盈亏均由物业服务企业承担的物业服务计费方式。
酬金制是指在预收的物业服务资金中，按约定比例或者约定数额提取酬金支付给物业服务企业，其余全部用于物业服务合同约定的支出，结余或者不足均由业主享有或者承担的物业服务计费方式。
第十条 物业管理区域内物业公共服务费用一般由下列因素构成：
（一）管理服务人员工资、社会保险和按规定提取的工会经费、职工教育经费等；
（二）物业共用部位、共用设施设备日常运行、维护保养费用；
（三）清洁卫生费用；
（四）绿化养护费用；
（五）秩序维护费用；
（六）办公费用；
（七）物业服务企业的固定资产折旧；
（八）物业共用场地、共用设施设备及公众责任保险费用；
（九）管理费分摊；
（十）经业主大会同意的其它费用；
（十一）法定税费以及合理利润。
